1. Introduction

Welcome to MyHives. These Terms & Conditions govern your access to and use of the MyHives platform, including the mobile application, website, routing and navigation features, Safety Diary, Trusted Circle, Panic and emergency support features, AI-assisted support features, and any related consumer services made available by MyHives Coöperatie U.A. through the MyHives brand.

By creating an account, accessing, downloading, activating, or using MyHives, you agree to these Terms. If you do not agree, you must not use the service.

These Terms are intended to create a clear and fair consumer contract, define how MyHives may be used, explain what MyHives does and does not promise, protect privacy and dignity, define responsibilities for user-generated content, preserve service flexibility, and establish a reasonable limitation of liability. That structure is consistent with EU consumer fairness rules, the Dutch approach to general terms, and the fact that hosted-content platforms in the EU may also have Digital Services Act responsibilities around moderation and notice-and-action processes.

2. Contracting entity and affiliated entities

These Terms form a binding agreement between you and MyHives Coöperatie U.A. for the use of the MyHives platform and consumer services.

MyHives Coöperatie U.A. may use affiliated entities, including MyHives B.V., and third-party service providers to develop, operate, host, secure, support, improve, or provide parts of the service. MyHives B.V. may own intellectual property and provide technical or operational services to the cooperative, but unless expressly stated otherwise, it is not the primary B2C contracting party for consumer use of the service.

MyHives Coöperatie U.A. may assign, novate, transfer, subcontract, or otherwise delegate any of its rights or obligations under these Terms to an affiliated entity, successor, purchaser, or service provider, including MyHives B.V., provided that your mandatory legal rights are not unlawfully reduced.

3. What MyHives is

MyHives is a consumer-facing safety, participation, and support platform. Depending on the features available to you, MyHives may allow you to:

  • log what you see and feel, privately or publicly;
  • create and manage safety-related entries in your Safety Diary;
  • use available signals and data to navigate from point A to point B;
  • discover locations and safety-relevant information;
  • identify companies, places, or spaces marked, classified, or described within the platform;
  • invite and manage a Trusted Circle;
  • share content or journey information with trusted contacts;
  • request emergency support through Panic and connected support flows;
  • and use AI-assisted tools such as myHive GPT or myHive OS for contextual assistance, translation, routing support, or logging support.

4. What MyHives is not

MyHives is not:

  • a public emergency authority,
  • a guaranteed police replacement,
  • a guaranteed ambulance or medical service,
  • a guaranteed private dispatch service,
  • a guarantee that any route, place, or person is safe,
  • or a guarantee that emergency assistance will arrive within a fixed timeframe unless separately promised in a specific written service-level agreement.

MyHives may help users move with more information, coordinate support, and request assistance, but route outputs, diary signals, panic flows, and community inputs remain assistive and informational. They do not replace official emergency authorities or the user's own judgment.

5. Eligibility and account rules

To use MyHives, you must have legal capacity to enter into this agreement or use the service under the supervision and authority required by applicable law.

You must:

  • provide accurate and current registration information,
  • keep your login information secure,
  • use only your own account unless MyHives expressly allows otherwise,
  • and notify MyHives promptly if you believe your account has been compromised.

You are responsible for activity on your account unless and until you have promptly reported unauthorised access and MyHives has had a reasonable opportunity to respond. If MyHives is made available to minors in any market, additional age, guardian, and consent rules may apply.

6. Privacy and related documents

Your use of MyHives is also subject to:

  • the MyHives Privacy Policy,
  • community or acceptable-use rules,
  • any safety or emergency notices,
  • and any product-specific terms for subscriptions, employer-sponsored access, or pilot features.

The Privacy Policy explains how MyHives processes personal data and sensitive platform data under the GDPR and related laws. These Terms should be read together with that policy because privacy, emergency support, AI use, and user-generated content overlap significantly.

7. User-generated content

You may be able to create, upload, record, save, publish, or share:

  • private diary entries,
  • public diary entries,
  • route preferences,
  • public or private positive or negative safety signals,
  • media such as images, audio, or video,
  • and user-directed disclosures to trusted contacts, employers, lawyers, or other selected recipients.

You retain ownership of your content, subject to the licence you grant to MyHives under these Terms.

7.1 Your responsibilities for content

When you create, upload, publish, or share content through MyHives, you represent and warrant that:

  • you own the content or have the right to use and share it;
  • the content is not knowingly false, unlawful, misleading, or defamatory;
  • the content does not unlawfully disclose another person's private, identifying, or sensitive information;
  • the content does not infringe any intellectual property, privacy, personality, image, confidentiality, or other rights;
  • and you will promptly correct or remove content if you later learn it is wrong, misleading, unauthorised, or unlawfully shared.

7.2 Prohibited sensitive disclosures

You must not upload, publish, or share:

  • intimate images of others without lawful authority;
  • identifying information about others where it is not necessary or lawful;
  • health, ethnicity, sexuality, religion, political opinions, or similar sensitive data about others without a valid legal basis;
  • or allegations about identifiable people that you are not lawfully and responsibly entitled to make.

7.3 Platform protection

MyHives provides a technology platform and moderation framework. You remain responsible for the content you create, publish, or direct-share, and for ensuring you have the rights and lawful basis to do so. MyHives may investigate, restrict, remove, preserve, or disclose content where necessary to enforce these Terms, protect users or third parties, comply with law, investigate abuse, or support a lawful safety or legal process.

8. Public, private, and directed sharing

8.1 Private content

Private content is intended to remain private within the MyHives-controlled environment, subject to:

  • normal service operation,
  • security and abuse review,
  • support and troubleshooting,
  • emergency handling,
  • and lawful disclosure obligations.

8.2 Public content

If you choose to make content public, you understand that it may become visible to:

  • all users of the platform,
  • non-users where the feature allows public visibility,
  • search engines or publicly indexable interfaces,
  • and recipients beyond the platform if copied, shared, or republished.

Others may copy, share, index, cache, screenshot, or republish it, and MyHives cannot control all downstream uses.

8.3 Directed sharing

If you direct-share content with a Trusted Circle member, an employer, a company, a lawyer, or another selected recipient, that disclosure is made at your instruction. Once disclosed, the recipient may hold or use that information under its own legal duties or internal policies.

9. Trusted Circle

Trusted Circle is a user-directed support feature. You choose whom to invite, accept, remove, mute, or block.

By participating in a Trusted Circle relationship, you acknowledge that certain information, such as trip status, journey visibility, or emergency-related information, may be shared with selected participants when the feature is activated.

You may revoke Trusted Circle access, but revocation does not erase information already seen, saved, copied, or acted upon by the other participant.

10. Nest navigation and route information

Nest provides route suggestions based on available data, user preferences, public and private signals where applicable, platform logic, and third-party routing services. Route recommendations are informational and assistive. They are not guarantees of safety, suitability, legality, accessibility, or risk elimination.

You may set route preferences and avoid or prefer certain signals. MyHives will try to reflect these preferences, but may still show routes that do not fully match them if:

  • data is incomplete,
  • no ideal route exists,
  • circumstances change in real time,
  • or practicality requires compromise.

11. Panic and emergency support

Panic is one of the most sensitive and important features in MyHives. It may:

  • alert a Trusted Circle,
  • capture or transmit location,
  • connect to an alarm centre or support partner,
  • record or stream audio or video,
  • provide live translation or communication support,
  • and support escalation to public authorities where appropriate.

11.1 No guaranteed timing or outcome

MyHives will use reasonable efforts to make panic and emergency support features available and to work with emergency support partners, but does not guarantee uninterrupted availability, successful transmission, immediate connection, immediate attendance, or response within any specific time. MyHives does not warrant that use of Panic or any emergency support feature will prevent harm, ensure rescue, secure law-enforcement attendance, or achieve any specific outcome.

11.2 Third-party emergency ecosystem

Alarm centres, security providers, translators, telecommunications providers, cloud providers, mapping providers, network carriers, device manufacturers, and emergency authorities are independent third parties unless expressly stated otherwise. MyHives is not responsible for their delays, failures, availability, decisions, or acts or omissions, except to the extent liability cannot lawfully be excluded.

11.3 User duty in emergencies

If you are in urgent danger, call the appropriate emergency authority directly. MyHives is supplementary and not a substitute for official emergency channels.

12. Employer-sponsored access and dashboards

Some users may access MyHives through an employer, school, venue, city programme, or another organisational sponsor.

If an organisation buys panic licences, dashboard access, or other services for its employees or members, that does not automatically entitle that organisation to:

  • identify a reporting user,
  • access private diary content,
  • view private route history,
  • access Trusted Circle data,
  • or review personal emergency media.

By default, employer, venue, or organisational dashboard access is limited to aggregated, anonymised, pseudonymised, or otherwise privacy-protected information unless the individual user explicitly chooses to share more specific information, disclosure is required by law, or disclosure is necessary for a defined emergency process. MyHives is not sold or positioned as a general employee-surveillance tool.

13. AI-assisted features

MyHives may include AI-assisted features such as myHive GPT or myHive OS, including:

  • AI-supported conversations,
  • AI-assisted diary drafting,
  • translation,
  • contextual route or safety assistance,
  • and limited camera/audio interpretation where enabled.

AI is assistive, not authoritative. If AI helps you create or translate content, you remain responsible for reviewing, correcting, confirming, or deleting it before publication or sharing, especially where it concerns other people or public allegations. Where required, MyHives will identify AI interactions or AI-assisted outputs in line with evolving transparency obligations under the EU AI Act.

14. Licence you grant to MyHives

You retain ownership of the content you create, subject to the rights you grant to MyHives.

You grant MyHives Coöperatie U.A. and its affiliates, service providers, and processors a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, translate, analyse, adapt, and display your content only as needed to:

  • operate the service,
  • provide features you use,
  • improve safety scoring and route logic,
  • support moderation, support, and security,
  • and, where lawful and permitted, improve models, service quality, and workflow quality.

15. Acceptable use and prohibited conduct

You must not:

  • use the platform unlawfully;
  • impersonate another person;
  • abuse emergency features;
  • submit false emergency triggers;
  • harass, threaten, stalk, or surveil others unlawfully;
  • spam, scrape, or reverse engineer beyond lawful limits;
  • interfere with security, availability, or technical operation;
  • or use MyHives to facilitate illegal conduct.

False or malicious use of emergency tools may result in suspension, termination, reporting to authorities, or claims for resulting losses where permitted by law.

16. Suspension, restriction, and termination

MyHives may suspend features, remove content, limit accounts, terminate access, or deny use where reasonably necessary for:

  • safety,
  • security,
  • abuse prevention,
  • fraud prevention,
  • legal compliance,
  • or platform integrity.

Where legally required or fair in the circumstances, MyHives will provide notice or reasons. In urgent or safety-sensitive circumstances, MyHives may act first and explain after.

17. Service changes and feature evolution

MyHives may change, improve, suspend, or discontinue all or part of the service at any time. This may include:

  • modifying features,
  • adding or removing products,
  • changing interfaces,
  • retiring beta or pilot features,
  • changing paid/free positioning,
  • changing support models,
  • or changing emergency support partners.

Where required by law or where a change materially affects paid users, MyHives will provide reasonable notice.

18. Subscriptions, billing, and cancellations

If you purchase a paid subscription, panic plan, or other paid feature:

  • the pricing, billing frequency, renewal mechanics, and plan scope presented at purchase form part of your contract;
  • recurring billing may continue until cancelled where clearly disclosed;
  • cancellation rules, refund rules, and trial rules will apply as stated at the point of purchase;
  • and access may be suspended or reduced after non-payment.

If EU consumer withdrawal or cooling-off rules apply to a purchase, they will apply to the extent required by law.

19. Intellectual property

All intellectual property rights in the app, platform, software, safety scoring, route scoring, data structures, models, design, brand assets, and MyHives-created content remain with MyHives or its licensors.

You receive a limited, revocable, non-exclusive, non-transferable licence to use the app and services in accordance with these Terms.

20. Privacy, lawful disclosure, and court orders

MyHives will strive to protect user privacy and handle personal data in accordance with its Privacy Policy and applicable law. However, MyHives may preserve, access, review, or disclose information where reasonably necessary to:

  • comply with law,
  • respond to lawful court orders or authority requests,
  • address emergency necessity,
  • investigate fraud or abuse,
  • protect the platform,
  • enforce these Terms,
  • or defend rights, safety, and property.

MyHives is not liable for disclosures made in good faith pursuant to legal obligation, lawful process, emergency necessity, or the enforcement of these Terms and applicable law.

21. Limitation of liability

To the extent permitted by law, MyHives excludes liability for:

  • indirect loss,
  • consequential loss,
  • lost profits,
  • lost opportunity,
  • reputational harm,
  • emotional distress not arising from unlawful conduct by MyHives,
  • third-party acts or failures,
  • interruptions,
  • network failures,
  • data loss outside MyHives' control,
  • and user-generated content by others.

21.1 Liability cap

For paid users, MyHives' total aggregate liability arising out of or relating to the service is limited to the greater of:

  • the total amount paid by that user to MyHives in the 12 months before the event giving rise to the claim, or
  • EUR [insert fixed cap after legal review].

For free users, MyHives' total aggregate liability is limited to EUR [insert lower fixed cap after legal review], subject always to mandatory law.

21.2 Non-excludable liability

Nothing in these Terms excludes or limits liability for:

  • wilful misconduct,
  • fraud,
  • death or personal injury where non-excludable,
  • or any liability that cannot lawfully be excluded or limited.

22. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless MyHives Coöperatie U.A., its affiliates, officers, employees, contractors, and service providers against losses, claims, damages, liabilities, and reasonable legal costs arising from:

  • your unlawful content,
  • your breach of these Terms,
  • your misuse of emergency features,
  • your infringement of another person's rights,
  • or your unlawful disclosure of other people's personal data.

This indemnity applies only to actual user wrongdoing or breach and is not intended to override mandatory consumer protections.

23. Complaints and dispute resolution

If you have a complaint, you should first contact MyHives through the contact and support channels provided in the app or website. MyHives will use reasonable efforts to review and respond.

These Terms are governed by Dutch law, without prejudice to any mandatory consumer protection rights you may have under the law of your country of habitual residence.

For business users and non-mandatory cases, disputes may be brought before the competent courts in the Netherlands. For consumer users, nothing in these Terms deprives you of mandatory forum or protection rights that apply under law.

24. Changes to these Terms

MyHives may update these Terms from time to time. If changes are material, MyHives will provide notice by reasonable means, such as in-app notice, email, push notification, or another service communication.

Continued use of the service after the effective date of the updated Terms constitutes acceptance to the extent permitted by law. If you do not agree, you must stop using the service and, where applicable, cancel your account or subscription.
